TAG 167 [Ini satu rencana yang amat penting yang MESTI DIBACA dan MESTI DISEBAR.
Ia menunjukkan kelemahan Mahathir adalah keaibannya dan kebangkitan kaum
hawa yang didokong oleh isteri dan anak-anak tahanan ISA amat mengancam
lagi berkesan. Tidak ada satu pun soalan berbentuk keganasan bom atau
roket terhadap Gobalakrishnan - sebaliknya cerita seks pula yang menjadi
sasaran. Apa yang menarik polis seperti berkempen untuk keselamatan BN -
bukan untuk keselamatan negara. Ada sesuatu yang pelik di sini. Mengapa
Suhakam tidak menyambut atau menyoal-siasat Gobalakrishnan ketika dibebaskan.
Sepatutnya Suhakamlah yang mula-mula menggali maklumat penderaan terhadap
Gobalakrishnan - bukannya akhbar siber.

Oleh: Susan Loone Seorang bekas tahanan ISA menceritakan bagaimana dia disoalsiasat
berjam-jam lamanya mengenai pengalamannya dengan wanita dan bukannya
mengenai tuduhan-tuduhan bahawa dia bercadang menjatuhkan kerajaan
melalui tindakan militan. 'Tidak ada satu soalan tentang bom, molotov koktel, ataupun
kerja-kerja militan,' demikian kata Ketua Pemuda Keadilan
N.Gobalakrishnan kepada Malaysiakini dalam satu wawancara eksklusif.
'Sebaliknya mereka memberitahu saya betapa Tian (Chua) dan Ezam Mohd Nor
telah mengaku betapa mereka meniduri ramai perempuan, dan saya mesti juga
berbuat pengakuan yang serupa,' katanya.
'Mereka telah juga memberitahu sebab saya ditangkap ialah kerana saya
kerap mengaibkan perdana menteri dengan menyebut 'Mahathir undur' ketika
berceramah.' Gobalakrishnan adalah antara 10 aktivis reformasi yang telah ditahan
bawah undang-undang ISA yang membolehkan penahanan tanpa perbicaraan,
dalam satu operasi polis bermula 10 April. Beliau dan seorang ketua
pemuda Abdul Ghani Haroon, telah dibebaskan oleh Mahkamah Tinggi Shah Alam
setelah ditahan selama 51 hari. Dua orang lagi telah dibebaskan tanpa
syarat oleh pihak polis. Namun, empat orang lagi, timbalan presiden Keadilan Tian Chua, pemimpin
pemuda Ezam dan Shaari Sunghib, dan kolumnis Malaysiakini Hishamuddin Rais,
telah dihanttar ke Kemunting di Perak pada 2 Jun, untuk ditahan
selama dua tahun atas arahan Menteri Dalam Negeri Abdullah Ahmad
Badawi. Nasib ahli majlis tertinggi Keadilan, Dr. Badrul Amin Bahiron dan seorang
lagi pemimpin pemuda parti itu Lokman Noor Adam, yang ditahan pada 20
dan 24 April, masih belum diketahui. Permohonan habeas corpus di
Mahkamah Tinggi Shah Alam akan didengar esok hari.
Habeas corpus ialah satu writ yang memerintahkan banduan dihadapkan
kepada seorang hakim untuk menentukan kesahihan penahanannya.
Harimau Tamil Gopalakrishnan telah memberitahu Malaysiakini apabila dia enggan
mengaku segala tuduhan kelakuan seksualnya, dia telah dijerit dan
didera dan ditolak ke dinding oleh para penderanya.
'Pada satu hari mereka membiarkan seorang anggota polis yang besar
tubuh badannya yang memang menggerunkan. Dia telah menolak saya
daripada tempat duduk dan menekan saya ke dinding dan berkata: 'Aku
pernah mendera orang Tamil Elam, dan engkau tidak perlu berlagak,'
katanya.' 'Pernah mereka mahukan saya membuat pengakuan kerana telah menerima
banyak maklumat. Saya hanya perlu menceritakan yang benar dan jika
enggan, saya akan dihantar ke Kemunting,' tambah beliau.
Gobalakrishnan menceritakan para pendera itu menghabiskan masa yang
panjang setiap hari dimana tiga hingga empat anggota polis menderanya
pada sekali masa. Sepanjang penahanannya itu, terdapat 12 pegawai polis
yang berasingan, tiga daripadanya kaum India, tiga Cina dan enam
Melayu. Dia tidak dapat membezakan perjalanan masa setiap penderaan itu
kerana dia sudah kehilangan arah akan peredarannya.
Gopalakrishnan menambah betapa dia diberitahu yang isterinya R. Vasanthi
telah pun mjenghilangkan diri, dan sedang menjalin hubungan dengan
lelaki lain dan dia juga sentiasa menghadiri ceramah dengan ditemani oleh
pemimpin pemuda PAS, Mahfuz Omar. Dia juga memberitahu bagaimana
polis telah mengugutnya untuk menahan isternya juga seandainya dia terus
berkempen terhadap ISA ketika ceramah itu.
'Kasihanilah anak-anak kamu, kata mereka. Apa akan jadi kepada mereka
kalau kami tahan isteri kamu pula,' kata Gobalakrishnan.
'Saya beritahu mereka terdapat 1,000 penyokong di luar sana yang sanggup
menjaga keselamatan keluarga saya. Saya tidak akan menahan isteri saya
(menghadiri ceramah itu),' katanya.
Propaganda Mengikut kata Gobalakrishnan, dia dikurung sendirian dalam satu bilik
yang berukuran lapan kali enam kaki dengan satu lampu kecil yang
meneranginya. Dia terpaksa tidur tanpa bantal dan selimut. Pancuran mandi
dan kemudahan tandas memang terdapat di kamar itu.
'Itu memang kerja penderaan yang mengaibkan. ISA tidak layak untuk
manusia,' kata beliau. 'Mereka sediakan makanan yang tidak boleh saya makan. Saya dihinggapi
penyakit gusi dan hampir mengalami masalah kesihatan kerana terpaksa
membuat gerakan riadah dengan pakain penjara yang tidak menyediakan
seluar dalam.' Ketika seorang doktor datang memeriksanya dia telah meminta diberikan
masakan India, dan seluar dalam, tetapi hapah pun tidak ada.
Gobalakrishnan tidak diizinkan sebarang pelawat selama lebih satu bulan.
Dia mengatakan bagaimana dia sentiasa diberitahu betapa keluarganya
enggan menemuinya dan tidak ambil kisah akan dirinya.
'Mereka menunjukkan keratan akhbar tentang permohonan habeas corpus
yang membabitkan rakannya yang lain, tetapi menyatakan tidak ada
sesiapa yang memohon untuk saya,' katanya .
Gopalakrishnan menuduh bahawa para penderanya berlagak lebih hebat
laksana pakar propaganda Barisan Nasional daripada sebagai pegawai
polis. Dia mengatakan betapa pihak polis semakin risau apabila
pergerakan anti-ISA dikendalikan oleh para isteri, sahabat dan keluarga
para tahanan. 'Mereka cuba memutar minda saya mengenai BN. Mereka terus memberitahu sya
bahawa Mahathir adalah manusia baik, dan Anwar tidak baik kerana mereka
telah menyaksikan Anwar melakukan kerja yang tidak senonoh,' kata
Gobalakrishnan. Dia telah mencabar pegawai polis itu bersumpah kepada Allah kerana
telah menyaksikan perbuatan Anwar sebegitu tetapi mereka hanya berdiam
membisu dengan cabarannya itu. Mantan timbalan perdana menteri kini sedang menjalani hukuman 15
tahun penjara di Sungai Buluh kerana (apa yang dikatakan) korupsi dan
perbuatan tidak senonoh. 'Soal-siasat mereka memang bersifat perkauman. Mereka kerap mendesak saya
menganggotai MIC semula kerana Keadilan tidak berlaku adil kepada orang
India. Mereka memberitahu saya untuk menganggotai IPF ataupun PPP di
mana saya mempunyai masa yang cemerlang.'
Suhakam Yang Tidak Bebas Gobalakrishnan berkata apabila dia ditemui oleh perwakilan Suhakam di
ibupejabat polis Kuala Lumpur, dia telah ditemani oleh para penderanya
yang menyekatnya daripada bercakap kepada para suruhanjaya akan
pengalamannya ketika ditahan. 'Apabila saya disoal apakah ada apa-apa yang mahu saya cakapkan, para
pendera saya akan menyuruh pesuruhjaya itu berhenti di situ dan
menanyakan soalan lain,' kata beliau.
'Apabila pesuruhjaya itu menyoal saya cara saya dilayan ataupun
mengenai kesihatan saya, ada pendera saya yang mengatakan soalan tu
tidak relevan,' katanya. Gobalakrishnan menceritakan ada pesuruhjaya yang menanyakan kalau dia
diberikan makan tiga kali sehari dan samada dia dipukul, didera ataupun
dizalimi. Malahan, katanya, salah seorang pesuruhjaya itu perasan betapa saya
kelihatan lemah, menggeletar dan mencungap-cungap.
'Pesuruhjaya itu menanyakan umur saya, dan apabila saya sebut saya
berusia 41, mereka menjadi terkejut,' katanya.
Dia berkata, pertemuan dengan Suhakam, tidak membawa sebarang makna.
'Mereka mudah dikelentong oleh polis. Sepatutnya mereka menemui kami
selepas kami dibebaskan,' kata beliau.
Pada 24 Mei, empat orang pesuruhjaya Suhakam - Anuar Zainal Abidin,
Mehrun Siraj, Dr. Mohammad Hirman Ritum Abdullah dan Prof Hamdan Adnan
- telah betemu 10 tahanan ISA secara berasingan, enam minggu selepas
Suhakam membuat permohonan itu kepada polis.
Mereka telah melaporkan betapa tidak ada penderaan terhadap 10 orang
tahanan itu, melainkan seorang tahanan yang mengatakan dia telah
ditolak ke lantai dari tempat duduknya dan menuduh dia tidak
dibenarkan membuat lapuran polis. Namun, Suhakam tidak pula menamakan sebarang tahanan dalam kenyataan
akhbarnya yang telah dikeluarkan selepas perjumpaan yang memakan masa
tiga jam. Gobalakrishnan menyebut dialah orang yang Suhakam maksudkan
sebagai ditolak ke lantai itu. Kenyataan itu juga menyebut nama timbalan pengarah Cawangan Khas
Abdul Razak Sulaiman dan seorang pegawai polis lagi telah menghadirkan
diri di sepanjang pertemuan itu. Gobalakrishnan menyatakan betapa dia dinafikan hak berjumpa peguamnya
ketika dalam tahanan. Dia juga kerap dinafikan haknya membuat aduan
terhadap para penderanya. Dia berkata, pada hari dia diarahkan bebas
oleh Mahkamah Tinggi Shah Alam, dia telah di kurung dalam satu lokap
mahkamah dan telah didatangi oleh sekitar 30 anggota cawangan khas .
'Saya fikir mereka mahu mengecam muka saya supaya mudah menangkap
saya semula apabila dibebaskan,' katanya.
Dalam satu keputusan yang bersejarah, Hakim Mahkamah Tinggi Shah Alam
YA Mohd Hishamuddin Mohd Yunus telah mengarahkan Gobalakrishnan dan
Abdul Ghani Haroon dibebaskan atas alasan penahanan mereka di bawah
ISA adalah tidak sah, dilaksanakan dengan niat jahat dan alasan
yang tidak jelas. Hishamuddin juga memberikan arahan agar polis tidak menangkap mereka
semula dalam waktu 24 jam selepas dibebaskan.
Ketua Polis Negara telah pun mengemukakan rayuan terhadap penghakiman
Hishammuddin itu dan perkara itu akan didengar di mahkamah persekutuan
pada 18 Jun. Ditanya apa perasaannya terhadap penghakiman itu, Gobalakrishnan
berkata. 'Suara Hakim Hishamuddin seolah-olah merupakan suara Yang
maha Esa untuk saya pada hari itu. Doa permohonan kami telah
dimakbulkan.' Asal: Wednesday June 13 Nothing on bombs, just sex: Ex-ISA detainee on interrogation
By Susan Loone 4:57pm, Wed: exclusive A former ISA detainee today claimed that he was
interrogated for hours about his sexual encounters with various women
instead of allegations that he had sought to topple the government through
militant means. 'There was not a single question regarding bombs, Molotov c##ktails or
militancy,' Keadilan Youth leader N Gobalakrishnan told malaysiakini in an
interview. 'Instead they (the interrogators) told me two other detainees, Tian (Chua)
and (Mohamad) Ezam (Mohd Nor) had both confessed that they slept with
many women, and I must do the same (confess),' he said.
'They also told me the reason for my arrest which was that I often insulted
the prime minister by saying 'Mahathir undur' (resign)' during my
ceramah,' he added. Gobalakrishnan was one of the 10 reformasi activists who were detained
under the Internal Security Act (ISA), which allows detention without trial, in
a police crackdown beginning April 10.
He and party youth leader Abdul Ghani Haroon were ordered released by the
Shah Alam High Court after spending 51 days in detention while another
two were released unconditionally by police.
However, four others - Keadilan vice-president Chua, party youth leaders
Ezam and Saari Sungib, and malaysiakini columnist-cum film-maker
Hishamuddin Rais - were sent to the Kamunting detention camp in Perak on
June 2 for a two-year detention period on orders of Home Affairs Minister
Abdullah Ahmad Badawi. The fates of Keadilan supreme council member Dr Badrul Amin Bahron and
another party Youth leader Lokman Noor Adam, arrested on April 20 and 24
respectively, are yet to be known. Their habeas corpus applications in the
Shah Alam High Court will be heard tomorrow.
Habeas corpus is a writ ordering prisoners to be brought before a judge to
ascertain whether their detention is lawful.
Tamil Tigers Gobalakrishnan told malaysiakini that when he refused to confess about his
purported sexual affairs, he was shouted at, harassed and pushed against
the wall by his interrogators. 'One day they sent a huge Indian policeman who was very intimidating. He
pushed me off my chair and held me against the wall and said, 'I have
interrogated the Tamil Tigers, and you are nobody',' he said.
'Another day they told me I must confess since they have all the
information. All I had to do was tell the truth and if I refused, I would be sent
to Kamunting,' he added. Gobalakrishnan said he was interrogated for long hours daily by three or
four policemen at any one time. Throughout his detention, he saw 12
different police officers, of whom three were Indians, three Chinese and six
Malays. He could not tell how many hours he was questioned each day since he lost
track of time, he said. Gobalakrishnan added he was also told that his wife R Vasanthi had left him,
that she had had affairs with other men and that she often attended
ceramah escorted by PAS Youth leader Mahfuz Omar.
He said that his interrogators slandered his wife, Keadilan president Wan
Azizah Wan Ismail and her daughter Nurul Izzah, saying they were all 'loose
women'. He added the police had threatened to detain his wife if she continued her
campaign against the ISA during opposition ceramah.
'Pity your children, they said. What would happen to them if we detain your
wife as well,' said Gobalakrishnan. 'I told them, there are 1,000 supporters out there who are willing to
safeguard my family. I am not going to stop my wife (from attending
ceramah),' he said. BN propagandists According to Gobalakrishnan, he was placed in solitary confinement in a
room measuring eight by six feet with one light bulb. He had to sleep on a
hard bunk with no pillow or blanket. Shower and toilet facilities were in the
same room, he added. 'It was mentally torturous. No one should be made to go through the ISA,'
he said. 'There was food but I could not eat. I suffered gum infection and nearly had
prostrate problems as I was made to do exercise daily wearing only the
lock-up clothes with no underwear,' he added.
He said when a doctor visited him, he requested for Indian food and
underwear, yet he received nothing. Gobalakrishnan did not have visitors for more than a month. He claimed he
was constantly told that his family did not want to see him and were not
bothered with him. 'They showed newspaper cuttings of habeas corpus applications for my
other comrades but said no one did it for me,' he said.
Gobalakrishnan claimed that his interrogators acted more like Barisan
Nasional's propagandists than policemen.
He said the police were worried that an anti-ISA movement was being
conducted by wives, friends and families of the detainees.
'They tried to brainwash me about BN. They kept telling me that Mahathir is
good and Anwar is bad, that Anwar is truly a s###mist and they had seen
him committing the act,' Gobalakrishnan said.
He challenged the police officers to swear to God about witnessing Anwar's
s###my act, but this was met with silence from his persecutors.
Former deputy premier Anwar Ibrahim is currently serving a 15-year prison
term in Sungai Buloh prison for corruption and s###my.
'The interrogation was also very racist. They kept asking me to go back to
MIC as Keadilan treated Indians badly. They told me I could even join IPF or
PPP where I will have a good future,' he added.
Suhakam dictated Gobalakrishnan said when he met the delegation from the Human Rights
Commission (Suhakam) at the Kuala Lumpur police headquarters, he was
accompanied by his interrogators who prevented him from speaking to the
commissioners about his experiences while in detention.
'When I was asked if I had anything to say, my interrogators would tell the
commissioners to stop and go on to the next question,' he said.
'When the commissioners asked me about how I was treated or about my
health, my interrogators would say that the question was not relevant,' he
added. Gobalakrishnan said the human rights commissioners queried if he had his
three meals per day and whether he was beaten, assaulted or tortured.
However, he claimed that one of the commissioners noticed that he was
weak, shivering and breathing heavily.
'The commissioner asked for my age, and when I told them I was only 41,
they were shocked,' he said. He said that the meeting with the commissioners was pointless.
'They (the commissioners) were dictated by the police. They should meet us
after our release,' he added. On May 24, four Suhakam commissioners - Anuar Zainal Abidin, Mehrun
Siraj, Dr Mohammad Hirman Ritom Abdullah and Prof Hamdan Adnan - met
with the 10 ISA detainees separately, six weeks after the Commission made
their request to the police. They reported that there was no use of physical force on the 10 detainees,
with the exception of one who claimed to have been pushed to the ground
from his chair and was allegedly denied an opportunity to lodge a police
report However, Suhakam did not name any of the detainees in its press statement
which was released after the three-hour meeting. Gobalakrishnan said
Suhakam's reference to the detainee who was pushed from his chair was
him. The statement also said that Special Branch deputy director Abdul Razak
Sulaiman and another police officer were present throughout the interview.
Voice of God Gobalakrishnan also said he was denied access to his lawyer while in
detention. He added he had been repeatedly denied the right to make police
reports against his 'aggressors'. He said on the day he was ordered released by the Shah Alam High Court,
he was placed in the court's lock-up and was visited by about 30 Special
Branch officers. 'I presumed that they wanted to identify me so that they could re-arrest me
when I was released,' he said. In a landmark decision, Shah Alam High Court judge Mohd Hishammuddin
Mohd Yunos ruled that Gobalakrishnan and Abdul Ghani Haroon be released
on the grounds that their detention under the ISA was illegal, done in bad
faith and the evidence against them were vague.
Hishamuddin also requested the police not to re-arrest the duo for a period
of at least 24 hours if they intended doing so.
The Inspector-General of Police has since appealed against Hishammuddin's
judgment and the matter will be heard before the Federal Court on June 18.
Asked how he felt about the judgment, Gobalakrishnan said, 'Justice
Hishammuddin's voice was actually the voice of God for me on that day.
Our prayers were finally answered'. |
